Insanity Defense

The insanity defense is based on the argument that, at the time of the crime, the defendant had a severe mental illness to the extent that they could not understand the nature or wrongfulness of their actions. 

This defense is not about denying the commission of the crime but rather asserting a lack of guilt due to mental illness. If the insanity defense is successful, the defendant may be committed to a mental health facility rather than imprisoned. However, this outcome is highly contingent on rigorous evaluations and legal standards that vary by jurisdiction.

An example of a crime committed because of insanity is the case of John Hinckley Jr., who attempted to assassinate President Ronald Reagan in 1981. Hinckley had acute psychosis and was obsessed with actress Jodie Foster, believing that assassinating the president would impress her. 

During his trial, Hinckley's defense argued that he was legally insane at the time of the shooting, meaning he could not understand the wrongfulness of his actions because of his severe mental disease. The jury accepted the insanity defense, finding Hinckley not guilty because of insanity. As a result, instead of being sent to prison, Hinckley was committed to a psychiatric hospital for treatment.

Guilty but Mentally Ill (GBMI) Defense

The GBMI defense acknowledges that the defendant had a mental illness at the time of the crime but maintains that they were still capable of understanding their actions and distinguishing right from wrong. This verdict allows for the defendant to be held accountable for their actions while also recognizing they have significant mental health issues. A GBMI verdict often results in imprisonment but includes provisions for treatment, either within the penal system or in a mental health facility.

Diminished Capacity Defense

While not absolving the defendant of the crime, this defense acknowledges that mental health issues may have impaired the defendant's ability to fully intend the crime they committed, potentially leading to reduced charges.

 It seeks to reduce the charges or the severity of the punishment. For example, it might reduce a murder charge to manslaughter if the defendant's mental state can be proven to have impaired their judgment or impulse control, leading to the offense. 

The consequences typically involve a reduced sentence, reflecting the diminished capacity rather than a complete exemption from punishment.

Competency to Stand Trial

Competency to stand trial determines whether the defendant has the mental capacity to understand the charges against them and the court proceedings and to communicate effectively with their attorney. 

It is a fundamental legal principle that a person unable to comprehend or participate in their defense cannot be tried. If deemed incompetent, the defendant may undergo treatment to restore competency. If competency is not restored, the defendant may be held in a mental health facility, but not as a form of punishment for the crime.
